MINUTES OF A REGULAR MEETING

 ZONING BOARD OF ADJUSTMENT OF THE BOROUGH OF MOUNTAIN LAKES

           March 1, 2007

 

Chair Jill Gotthelf called the meeting to order and read the Open Public Meeting Advertisement:  Notice of this meeting was given to the Citizen and the Daily Record, posted with the Borough Clerk and on the Bulletin Board and was made available to all those requesting individual notice and paying the required fee.  

 

ROLL CALL:

Present:  Gotthelf, Richter, Sheasby, Rusak, Max

Absent:  Bolo, Kane, Moody, Sullivan

Council Liaison – none

 

REVIEW OF MINUTES:  The minutes of the February 1 meeting were approved by voice vote.

MEMORIALIZING RESOLUTIONS:

Chris Richter made the motion to adopt the resolution of approval, seconded by Pat Rusak and carried by 2 - 0 roll call of eligible voters.

 

PUBLIC HEARINGS:  All applicants were sworn in by Chair Gotthelf.

Charles Graf and Architect Seth Leeb presented the application.  Graf noted that his family of six moved into this house four years ago and they need extra space.

Leeb noted that the house has existing nonconformities on the front and side.  They plan a four foot extension on the garage in the rear to connect the two garages internally.  They also plan to expand the crawl space next to the garage to create a basement.  This would be under the existing nonconforming side wall and would not exacerbate the nonconformity.  They do not plan to change the existing structure; however, if the wall collapses, it will be restored exactly as it is.  In response to Board questions, Leeb testified that the Zoning Officer did not require a topo.  There are some water issues so they will add sump pumps and French drains.

There was no public comment.  Bob Sheasby moved to approve the application as presented. Arthur Max asked for the condition that, if there is a collapse, it would be reconstructed as is. The motion was seconded by Pat Rusak and carried by 5-0 roll call vote.

Architect Marjorie Roller distributed revised FAR calculations (Exhibit A1) because half the front porch is enclosed in glass.  The front and side view photographs of the house was Exhibit A2.  There is a storage garage in the rear of the house but no driveway leads to it.  That garage will be removed and a new 2 car garage will be constructed, plus the addition of 38 square feet in the back of the kitchen.  A partial topographical survey, prepared by Richard Hudson, was marked Exhibit A3.  The driveway on the west side will be removed and a new driveway constructed on the east side of the house to access the garage.  The height of the house is 43 feet in the rear.  This addition will not alter that nonconformity.  Arthur Max moved to approve the application as filed, Bob Sheasby seconded the motion carried by 5-0 roll call vote.

Public comments:  none

Jill Gotthelf inquired whether there was a conflict with the April 5 meeting because of the scheduled school vacation.  Jim Moody will be absent and Chris Richter did not think he could attend.  Others were not aware of a conflict.  The meeting date will remain as scheduled.
