MINUTES OF A REGULAR MEETING

 ZONING BOARD OF ADJUSTMENT OF THE BOROUGH OF MOUNTAIN LAKES

January 3, 2008

 

Chair Peter Bolo called the meeting to order and announced:  Adequate notice of this meeting has been provided in accordance with the Open Public Meetings Act by posting written notice of the time, date, location and agenda of the meeting on the bulletin board in the Borough Hall and by transmitting such notice by fax to The Citizen and The Daily Record and by filing same with the Borough Clerk on December 20, 2007 and was made available to all those requesting individual notice and paying the required fee.  

 

ROLL CALL:

Present:  Bolo, Richter, Cohen, Kane, Sheasby, Rusak, Max                             Absent:  Moody

Also Present:  Attorney Michael Sullivan

Council Liaison – none

 

REORGANIZATION: 

Bob Sheasby made the motion to elect Peter Bolo as Chair, seconded by David Kane and carried by 7-0 roll call vote.  Bob Sheasby made the motion to elect Chris Richter as Vice-Chair, seconded by David Kane and carried by 7-0 roll call vote. 

David Kane made the motion, seconded by Mark Cohen and carried by 7-0 roll call vote, to approve the following:  Michael Sullivan, of the firm Stickel, Koenig and Sullivan, was appointed Counsel for the Board.  Margaret Jackson was appointed Administrative Officer/Secretary.  The Citizen and the Daily Record were designated as papers of notice for the Board.  The following dates were approved for regular meetings of the Board for 2008:

January 31        June 5              October 2

            March  6          July 3               November 6

            April 3              August 7           December 4

            May 1              September 4     January 8, 2009

 

REVIEW OF MINUTES:  The minutes of the December 6 meeting were approved by voice vote.

 

PUBLIC HEARINGS:

Other Matters / Public Comment:

Bob Sheasby moved to adopt the 2007 Annual Report, seconded by Chris Richter and approved by voice vote.

 

The public was reminded of the five minute limit to any individual’s comments.

 

Fred Kanter, 81 Hanover Road, made the following comments:

What I have seen as the erosion of democracy makes me cry.  I remember vividly what our soldiers fought for.  What I see practiced here is an insult to the public.  The license and restrictions upon the public is not how democracy works.  Mr. Bolo, where in the constitution does it say that I can not repeat previous comments?  I expect an apology.  Your putting a restriction of five minutes is a violation of my rights.  A judge found me innocent and no one has apologized.  I have asked for refund of my expenses and an apology from Chris Richter and Michael Sullivan.  I consider you dictatorial and fascist.  I am standing here in threat of arrest because I chose to say things that are unpopular.  If you don’t apologize….

Mr. Kanter was reminded that his five minutes had expired.  The police arrived and Kanter left the meeting.

 

The meeting was adjourned at 7:45 p.m.
