1.    CALL TO ORDER; OPENING STATEMENT: This meeting is being held in compliance

with Public Law 1975, Chapter 231, Sections 4 and 13, as notice of this meeting and the agenda thereof had been reported to The Citizen and the Morris County Daily Record and The Star Ledger on January 4, 2011 and posted in the municipal building.

 

Deputy Mayor Dan Happer called the meeting to order at 7:34 p.m.

 

2.    ATTENDANCE AND FLAG SALUTE

All Council members were present except for Mayor Charles Gormally who arrived at 7:41 p.m. Also in attendance were James Bryce, attending for Borough Attorney Marty Murphy, Borough Manager Barry Lewis, and Borough Clerk Christina Whitaker.

 

3.   EXECUTIVE SESSION - Resolution

 

            WHEREAS, the Borough Council of the Borough of Mountain Lakes, County of Morris, State of New Jersey finds it necessary to discuss matters relating to:

 

·         PBA Negotiations

·         Property Acquisition Proposal

·         King of Kings

 

            WHEREAS, the Borough Council believes it to be in the best interest of the public to discuss such matters in closed session.

 

            NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Mountain Lakes, that it shall enter Executive Session to discuss only those matters mentioned above; the results of which will be disclosed when the matters are resolved and upon vote of the Governing Body to release the minutes.

 

Motion by Councilman Shaw, second by Councilman Holmberg, to close the public portion of the meeting, and enter into Executive Session, with all members in favor signifying by “Aye”.

 

Motion by Deputy Mayor Happer, second by Councilman Shaw to closed the Executive Session and return to the public portion of the meeting, with all members in favor signifying by “Aye.”

 

4. COMMUNITY ANNOUNCEMENTS

Mayor Gormally said the Memorial Day festivities, sponsored by the Borough were wonderful. Councilman Holmberg noted that there were also several block parties throughout the Borough to celebrate the day.

 

Councilman Shaw reminded the public that donations were being accepted for the July 4th fireworks display. The fireworks this year will be launched from barges on Mountain Lake.

 

5. PUBLIC COMMENT

       Mayor Gormally opened the public comment portion of the meeting with consent of the

       Council.

             

       Mayor Gormally explained the Council’s policy of limiting each speaker to five (5) minutes      

       and no yielding of time to another person.

 

Fred Kanter – Hanover Road

Mr. Kanter said that the street sign at the corner of Cobb Road and Boulevard was missing and needed to be replaced immediately as he felt it was a matter of safety. He reminded the Council about compliance with State regulations regarding reflective signage.

 

 Eileen Wilson -3 Park Lane

Ms. Wilson, Vice President of the League of Women Voters of Mountain Lakes, thanked the Borough Council for its participation in Government Day at the Briarcliff School. Eighth grade students learned about the function of municipal government.

 

With no one else wishing to be heard, Mayor Gormally closed the public comment portion of the meeting.

       ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND

       TO  ESTABLISH A CAP BANK  (N.J.S.A. 40A: 4-45.14)

       If adopted this ordinance shall take effect after publication and passage as provided by law.        Public Hearing

Mr. Kanter said he hoped the budget included money for retro-reflective street signs.

AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF MOUNTAIN LAKES AND ADOPTING CERTAIN REGULATIONS REQUIRED BY THE NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION IN CONNECTION WITH THE DEPARTMENT’S WATER QUALITY MANAGEMENT PLANNING RULES. (Refuse Containers/Dumpsters and Private Storm Drain Inlet Retrofitting)

Following introduction, the above ordinance will be published in accordance with the law and a public hearing will be held on June 27, 2011.

 

Mr. Lewis explained that the New Jersey Department of Environmental Protection has mandated that New Jersey municipalities adopt this ordinance.

     Mr. Byrce had nothing to report.

     

     11. MANAGER REPORT

     Mr. Lewis said the 2011 municipal budget was available for the public to view on the Borough web site.

     

    The manager recognized members of the Police Department and the DPW workers for their additional work preparing the Borough for the Memorial

    Day festivities.

 

    Beach and Tennis tags are now on sale at Borough Hall. Summer camp signups are going strong.

 

    Art and Judy Muti have agreed to be the contact for residents interested in becoming members of the Bulletin Board Committee. Mayor Gormally said

    it was unrealistic to expect any long time commitment if only a few people were willing to be on the Committee.

 

   Mr. Lewis said he was obtaining quotes for an electronic bill board, explaining the practicality of replacing the old one with one that could be changed  

  from inside Borough Hall. Councilwoman Bravo suggested the Manager contact Chris Sullivan who has offered some suggestions. Councilman Shaw

  said this could be a project involving shared services or outsourcing.

 

   Mr. Lewis said that the Borough has not received a response from Bob Oostdyk’s letter to King of Kings.

 

  Councilman Shaw referred to the Health Officer’s report regarding a new preschool at the Wilson School. He expressed concern that the additional use

  may no longer comply with the original plans submitted to the Planning Board.

 

  Councilman Shaw said the Finance Committee was still looking for the five-year capital project plan.

 

  Councilman Holmberg said that weeds coming through the walls at the beaches could cause cracks in the walls.  Outside maintenance of Bentley’s and

 the former Christian book store also needed to be addressed.

 

 Councilman Shaw said he felt that the Zoning Officer need more hours so he could also deal with code enforcement issues.

 

 Councilwoman Bravo asked where the Borough stood on certification under Sustainable Jersey.  Councilman McWilliams said he would check with the

 Environmental Commission. The Sustainable Jersey sub-committee is part of the Commission.

 

Deputy Mayor Happer asked for an update on the repairs recommended by the energy audit. Mr. Lewis explained what items were to be addressed first.

 

The Council suggested the Police Chief be invited to a meeting to clarify some of the questions generated by the monthly reports.

 

12. COUNCIL REPORTS

Councilman Shaw said the Finance Committee would like an explanation regarding the delay in introducing the budget.  It was suggested that anyone on the Committee with questions should contact Mr. Lewis.

 

Councilman Jackson said he would like the auditor to attend the first meeting in July.

 

Councilman Shaw said the Lakes Management Committee had ongoing concerns with timing issues on the dam project and the canal cleaning.

 

Councilman McWilliams said the Recreation Commission was working to address the issue of insurance coverage for all the sports in the Borough.  

 

The Centennial Committee has added a tennis event for June 25th.   There is a sailing event scheduled for July 2.

 

Councilman Holmberg reminded the Council of the upcoming Junior Fire Department dinner.

 

The Recreation Commission would like to have more interactive ability on the web site.

 

Councilwoman Bravo said the curbing and footings will be installed later this week at the cove.

Quotes are being solicited for a two-year contract for the maintenance of the new plantings. The information can be found on the Borough web site.

 

Councilman Jackson cautioned the committee about contracting for someone to care for the plants. He noted that in the past the Garden Club or volunteers have maintained public gardens in the Borough. Councilwoman Bravo said the money was in the Cove project’s budget and the Garden Club had already stated it was not interested in taking on the maintenance of the cove plantings.

 

Motion by Councilwoman Bravo, second by Councilman Holmberg, to appoint John Lester as 2nd alternate to the HPC, with all members in favor signifying by “Aye.”

 

Motion by Councilman Jackson, second by Councilman McWilliams, to appoint Eva Messick to the Traffic and Safety Committee, with all members in favor signifying by “Aye.”  

 

The HPC has formed an eight member AdHoc committee to work on drafting an ordinance for review by the Council. One of the purposes of the ordinance is to offer incentives for the preservation of Hapgood and Bell homes. Councilman Shaw asked that the AdHoc Committee publish its meeting times, agenda and minutes on the website.

 

The Shade Tree Commission is promoting the sale of 100 trees to celebrate the Centennial.

 

Councilman Jackson said the sign to Barton Road is missing and in its place is the street sign dedicated to Brigadier General Frederic Castle. Mr. Lewis said when the DPW installed the new sign the Barton Road sign was already missing. It was not the intention to rename the road. A new Barton Road sign will be installed.

 

Councilman Jackson updated the Council on a recent decision by the Zoning Board regarding an undersized lot on Fanny Road.

 

The Personnel Committee will be meeting with the Manager next week to discuss issues relating to the general office and CFO’s function.

 

13. PUBLIC COMMENT

Mr. Kanter said the police and DPW workers needed to be more pro-active when it comes to missing and broken street signs as well as visibility issues due to over grown vegetation.

 

With no one else wishing to be heard, Mayor Gormally closed the public comment portion of the meeting.

 

Motion by Councilman Shaw, second by Councilman McWilliams, to return to Executive Session to discuss a property acquisition issue, with all members in favor signifying by “Aye.”

 

Motion by Councilman Holmberg, second by Councilman Shaw, to close the Executive Session and return to the public portion of the meeting, with all members in favor signifying by “Aye.”

 

Motion by Councilman Shaw, second by Councilman Holmberg, to retain Arthur Thibault as the Borough’s Special Counsel for the PBA negotiations, subject to a cap of $10,000, with all members in favor signifying by “Aye.”

 

The Council agreed to accept the conveyance of a portion of Block 53, Lot 39 from Councilman Jackson.  

 

14. ADJOURNMENT

Motion by Councilman Shaw, second by Councilwoman Bravo, to adjourn the meeting at 10:10 p.m., with all members in favor signifying by “Aye.”
