1.  CALL TO ORDER; OPENING STATEMENT: This meeting is being held in compliance

with Public Law 1975, Chapter 231, Sections 4 and 13, as notice of this meeting and the agenda thereof had been reported to The Citizen and the Morris County Daily Record and The Star Ledger on January 4, 2011 and posted in the municipal building.

 

Mayor Charles Gormally called the meeting to order at 7:32 p.m.

 

2.  ATTENDANCE AND FLAG SALUTE

All Council members were present except for Councilman Holmberg who arrived at 7:34 p.m. and Deputy Mayor Happer who arrived at 7:36 p.m.

Also in attendance were Borough Attorney Marty Murphy, Borough Manager Barry Lewis, and Borough Clerk Christina Whitaker.

 

3. EXECUTIVE SESSION – Resolution 111

 

            WHEREAS, the Borough Council of the Borough of Mountain Lakes, County of Morris, State of New Jersey finds it necessary to discuss matters relating to:

 

·        Personnel

 

            WHEREAS, the Borough Council believes it to be in the best interest of the public to discuss such matters in closed session.

 

            NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Mountain Lakes, that it shall enter Executive Session to discuss only those matters mentioned above; the results of which will be disclosed when the matters are resolved and upon vote of the Governing Body to release the minutes.

 

Motion by Councilman Jackson, second by Councilwoman Bravo, to enter into Executive Session, with all members in favor signifying by “Aye.”

 

Motion by Councilman Jackson, second by Deputy Mayor Happer, to close the Executive Session and return to the public portion of the meeting, with all members in favor signifying by “Aye.”

 

4. COMMUNITY ANNOUNCEMENTS

The Council and public are invited a Recycling Facility Open House sponsored by Recommunity, the MCMUA and Morris Habitat for Humanity's ReStore on October 1 from 9 am to 4 pm in Mine Hill.

 

There will be a community wide event on October 16 in Denville to benefit the town’s flood victims.

 

5. WEB SITE COMMITTEE PRESENTATION (hereto attached)

Councilman Holmberg introduced Andy Bulfer the chair of the Web Site Committee.

 

Mr. Bulfer acknowledged his committee members and noted that all have technology backgrounds. He provided the Council with a history of the evolution of the web site and what the Committee would like to accomplish over the next few years.

 

Mr. Bulfer said it was difficult to envision what will be happening in the area of technology over the next five years.

 

He suggested the Borough expand use of the web site by Committees, Commissions and Boards. He proposed a blog for the Borough and on-line payment of taxes.

 

Mr. Bulfer said the Council would have to make a commitment In order to reach the objectives outlined.

 

6. PUBLIC COMMENT

       Mayor Gormally opened the public comment portion of the meeting with consent of the Council.

       Mayor Gormally explained the Council’s policy of limiting each speaker to five (5) minutes and no yielding of time to another person.

 

Missy Siddron/Wildwood School Teacher

Ms. Siddron explained that her son had been in a moped accident in the Borough and was seriously injured. She wanted to thank the two police officers who were at the scene of the accident and helped her son.  She said it bothered her that she did not automatically recognize the officers and did not know their names at that time. She offered suggestions that would help the school children recognize the Borough’s officers, including police trading cards containing safety messages. She said the cost could be covered with a grant. She said maybe the officers could think of some way that would help the children recognize them.

 

Nancy O’Reilly – Pocono Road

Ms. O’Reilly said she heard the Borough was considering building a community garden.

She expressed her concerns which included the use of fertilizers, parking issues, and watering sources.    

 

Harry Sun - 118 Intervale Road

Mr. Sun said he continued to be concerned about the house at 120 Intervale Road which is vacant and deteriorating. He said his wife had spoken with the Clerk, who then contacted the Borough’s Health Inspector. He asked if anything would be done to improve the site.

 

Mayor Gormally said he would talk to the Chief of Police regarding Ms. Siddron’s suggestions.

 

The Mayor explained to Ms. O’Reilly that the concept of a community garden was in an exploratory stage at this time and that no discussions by the Council have taken place regarding the matter.  

 

Mr. Lewis explained the situation at 120 Intervale Road. The property owner had been waiting to hear if the Historic Preservation Committee was still interested in restoring the house. However, Mr. Lewis said that money for acquisition did not exist at this time.

 

Councilwoman Wilson said the HPC was no longer interested in obtaining the house.

 9. ATTORNEY REPORT

 Mr. Murphy told the Council that King of Kings has applied for and will receive farmland assessment for 2012. The Church will be withdrawing its 2007-11 appeals.

 

10. MANAGER REPORT

Mr. Lewis explained that paving and milling of Intervale Road and the condo area would begin next week.

 

A DOT grant was being filed to do Powerville Road and Midvale sidewalks.

           

11. COUNCIL REPORTS

Environmental Commission

Motion by Councilman McWilliams, second by Councilman Holmberg, to appoint Marnie Vyff to the Commission, with all members in favor signifying by “Aye.”

 

Deputy Mayor Happer informed the Council that the Woodlands Committee will be planting American chestnut seedling in the Midvale area.

 

Mayor Gormally said the Planning Board was in the final stage of Master Plan review.

 

12. PUBLIC COMMENT

Mayor Gormally opened the second public comment portion of the meeting.

 

With no one wishing to be heard, Mayor Gormally closed the public comment portion.

 

Motion by Councilman McWilliams, second by Councilman Jackson, to reenter Executive Session, with all members in favor signifying by “Aye.”

 

Motion by Councilman Holmberg, second by Deputy Mayor Happer, to closed the Executive Session and return to the public portion of the meeting, with all members in favor signifying by “Aye.”

 

Borough Attorney Marty Murphy read into the minutes Resolution 112-11(Resignation of Barry Lewis)

 

Motion by Councilwoman Bravo, second by Deputy Mayor Happer, with all members in favor signifying by “Aye” with no one opposed.

Mayor Gormally announced that Police Chief Robert Tovo would be serving as Acting Borough Manager.

13. ADJOURNMENT 

Motion by Councilman Holmberg, second by Deputy Mayor Happer, to adjourn the meeting at 10:21 p.m., with all those in favor signifying by “Aye.”
