ORDINANCE 14-07

 

ORDINANCE AMENDING CHAPTER 173 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF MOUNTAIN LAKES AND ESTABLISHING A RESIDENCY REQUIREMENT FOR “SPECIAL USE” FACILITIES

 

            BE IT ORDAINED by the Borough Council of the Borough of Mountain Lakes, in the County of Morris and State of New Jersey, as follows:

 

            Section 1.     Chapter 173 of the Revised General Ordinances of the Borough of Mountain Lakes entitled "Parks and Recreation", Section 173-1 entitled "Lakes, parks and beaches," shall be amended by the inclusion of new subsection O. which shall read in its entirety as follows:

O.       Residency Requirement for Special Use Facilities.  Borough owned open space and parks shall be open to the public without regard to residency.  Special Use recreation facilities owned by the Borough and acquired solely with Borough funds shall be for the use of Borough residents, their guests, and recreation programs approved by the Recreation Commission.  Special use facilities include Island Beach, Birchwood Beach, Midvale Boat Launch, tennis courts, athletic fields, playgrounds, related picnic areas, and other facilities. 

 

            Section 2.       Chapter 173 of the Revised General Ordinances of the Borough of Mountain Lakes entitled "Parks and Recreation," Section 173-1 entitled "Lakes, parks and beaches," shall be amended by the following amendment to subsection B. which shall read in its entirety as follows:

            B.         Tags required.

            1.  Beach tag required.  All persons six years of age or older desiring to use the facilities at Island Beach or Birchwood Beach shall purchase a beach tag for the season, with the further privilege of purchasing daily guest badges.  Mountain Lakes residents, 62 years of age or older, may apply at Borough Hall for free tags.  No badge or tag shall be used or permitted to be used by anyone other than the registered holder thereof.

 

2.  Tennis tag required.  All persons desiring to use the tennis courts shall purchase a tennis tag.

 

            Section 3.       Chapter 173 of the Revised General Ordinances of the Borough of Mountain Lakes entitled "Parks and Recreation," shall be amended by the inclusion of new Section 173-9 to be entitled "Violations and penalties," and shall read in its entirety as follows:

           

§173-9.  Violations and penalties.

A.        Penalty.  Any person who shall violate any provision of this Chapter shall be subject to a penalty in accordance with §1-17 of this Code.

 

B.        In addition to such penalties as may be imposed by the Municipal Court, any person violating the rules and regulations of the Recreation Commission shall be subject to the suspension of their badge and related privileges.

 

            Section 4.     If any section or provision of this Ordinance shall be held invalid in any Court of competent jurisdiction, the same shall not affect the other sections or provisions of this Ordinance, except so far as the section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.

 

            Section 5.     All Ordinances or parts of Ordinances, which are inconsistent herewith are hereby repealed to the extent of such inconsistency.

 

            Section 6.     This Ordinance shall take effect immediately after final passage and publication in the manner provided by law.
