BOROUGH OF MOUNTAIN LAKES COUNCIL MEETING

MONDAY, April 28, 2008

M I N U T E S

 

1.      CALL TO ORDER; OPENING STATEMENT:  This meeting is being held in  compliance with

Public Law 1975, Chapter 231, Sections 4 and 13, as notice of this meeting and the agenda thereof had been reported to The Citizen and the Morris County Daily Record on January 3, 2008 and posted in the municipal building.

 

Mayor George Jackson called the meeting to order at 7:30 p.m.

 

2.      ATTENDANCE AND FLAG SALUTE

All Council members were in attendance except Councilman Gormally and Urankar. Also in attendance were Borough Manager Joe Tempesta, Borough Attorney Marty Murphy and Borough Clerk Christina Whitaker.

Councilman Gormally arrived at 7:33 p.m. and Councilman Urankar arrived at 7:35 p.m.

 

3.  EXECUTIVE SESSION

         Resolution 69-08

WHEREAS, the Borough Council of the Borough of Mountain Lakes, County of

Morris, State of New Jersey finds it necessary to discuss matters relating to,

 

·         Personnel Matters/Joe Tempesta

·         Interlocal Service Agreements

·         PBA Negotiations

 

WHEREAS, the Borough Council believes it to be in the best interest of the public to discuss such matters in closed session.

 

NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Mountain Lakes, that it shall enter Executive Session to discuss only those matters mentioned above; the results of which will be disclosed when the matters are resolved and upon vote of the Governing Body to release the minutes.

 

Motion by Councilman Shaw, second by Councilwoman Wilson, to enter into Executive

Session with all members in favor signifying by “Aye”.

 

Motion by Councilman Gormally, second by Councilman Shaw, to close the Executive Session

and return to the public portion of the meeting, with all members in favor signifying by “Aye.”

 

4. COMMUNITY ANNOUNCEMENTS

Mayor Jackson told the Council of an incident over the weekend in which three young men took a canoe out on Mountain Lake. The canoe flipped over leaving the three in the water and endangering their lives. One person was able to swim to shore but the other two needed to be rescued by Mountain Lakes police officers Brian Bolitski and Jason Dimick. Police Chief Tovo plans to acknowledge the officers’ bravery at a future meeting. The Council will prepare a Special Resolution.

 

A Special Resolution will also be drafted for Joe Cali and Former Fire Chief Tom Miller.

 

The Touch-a-Truck event is planned for this weekend by the Recreation Department.

 

5.  PUBLIC COMMENT

Mayor Jackson explained the Council’s policy of limiting each speaker to 5 minutes and no yielding of time to another person.

 

Mayor Jackson opened the public comment portion of the meeting with consent of Council.

 

Barbara Palmer, Chair of the Master Plan Committee, updated the Council on its recommendations. She explained that the Committee hoped to have changes submitted to the Planning Board by June. A reexamination report must be adopted by October 16, 2008. A public hearing will be necessary before adoption of any recommended changes. She indicated that the Borough would receive a grant to rewrite the historic preservation portion of the Master Plan.

 

With no one else wishing to be heard, Mayor Jackson closed the public comment portion of the meeting.

 

6. 2008 BUDGET PUBLIC HEARING

Be it Resolved by the Governing Body of the Borough of Mountain Lakes, County of Morris that the budget herein before set forth is hereby adopted and shall constitute an appropriation for the purposes stated of the sums therein set forth as appropriations, and the authorization of the amount of $4,551,685.45 for municipal purposes.

 

 Kathi Mantell informed the Council that any restored State Aid would be used to reduce the tax levy.

 

 Mayor Jackson opened the Public Hearing on the 2008 Municipal Budget.

 

       Steve Castellucci – Laurelwood Drive

  Mr. Castellucci said he was disappointed that the Council did not include money in the budget to

  have an independent agency conduct an operational audit of Borough departments.

 

  With no one else wishing to be heard, Mayor Jackson closed the Public Hearing.

7. ORDINANCE

03-08

ORDINANCE AMENDING CHAPTER 173 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF MOUNTAIN LAKES ENTITLED “PARKS AND RECREATION” SECTION 173-1.

If adopted this ordinance shall take effect after publication and passage as provided by

          law. PUBLIC HEARING

10.     ATTORNEY’S REPORT

      Final Court Order/Kanter v Borough of Mountain Lakes

Mr. Murphy explained the specifics of the order signed by the Judge

 

Motion by Mayor Jackson, second by Councilwoman Emr, to pledge $500 to the NJ League of

Municipalities Legal Fund to handle possible litigation involving COAH regulations, with all members in  favor signifying by “Aye” by Roll Call vote. 

 

      Councilman Urankar asked Mr. Murphy to provide the Council with information on the disposition of

      the Morris Avenue police incident handled by JIF.

 

     11. MANAGER’S REPORT

 Resignation of Diane Hertzig

 Mr. Tempesta explained that he had advertised for a new administrative assistant on the Borough

web site because Mrs. Hertzig had taken a job with the Hanover Township Board of Health.

    

    Mr. Tempesta reported that the sidewalks on Powerville were 95 % completed.

 

Mr. Tempesta said he authorized sidewalk work to be done in the Esplanade area which was in need

of repairs.

 

 Department heads met with the architect for Borough Hall. A needs assessment will be completed

 soon.

 

 The cost for repairs to well #3 will be presented at the next meeting.

           

12. COUNCIL REPORTS

Council liaisons reported on meetings they attended.

 

Motion by Councilman Gormally, second by Councilwoman Wilson, to go back into Executive Session to discuss personnel matters with Mr. Tempesta at 9:15 p.m., with all members in favor signifying by “Aye.”

 

 Motion by Councilman Urankar, second by Councilman Shaw, to close the Executive Session and return to the public portion of the meeting at 9:30 p.m., with all members in favor signifying by “Aye.”.

 

The Council discussed the Wilson and Craig Schools and the possibility that space may become available within the next 5 years at one of the schools.

 

13. ADJOURNMENT

On Motion by Councilman Gormally, second by Deputy Mayor Davis, to adjourn at 9:35 p.m.  with all members in favor signifying by “Aye.”
