1.
CALL TO ORDER; OPENING STATEMENT: This
meeting is being held in compliance
with Public Law 1975, Chapter 231, Sections 4 and
13, as notice of this meeting and the agenda thereof had been reported to The
Citizen and the Morris County Daily Record on January 3, 2008 and
posted in the municipal building.
Mayor
George Jackson called the meeting to order at 8 p.m.
2.
ATENDANCE AND FLAG SALUTE
All Council members where in attendance
except for Councilman Shaw and Councilwoman
Wilson.
Also in attendance were Borough Attorney
Marty Murphy, Borough Manager Joe Tempesta,
and Borough Clerk Christina Whitaker.
3. COMMUNITY ANNOUNCEMENTS
Mayor Jackson led the Memorial
Day Parade along with Col. Courtney Whitney, III, and newly commissioned Marine
2nd Lt. Alex Urankar. The parade was well attended by community
members.
Betty Yerkus was named
Mother of the Year by NBC’s Today Show.
Tom Menard was name Citizen
of the Year by the YMCA.
Mountain Lakes Day was very
successful thanks to the efforts of Allison Fenton and Chris Palazzi.
Councilwoman Wilson arrived
at 8:05 p.m.
4. PUBLIC COMMENT
Mayor
Jackson explained the Council’s policy of limiting each speaker to 5 minutes
and no yielding of time to another person.
Mayor Jackson opened
the public comment portion of the meeting with consent of Council.
Angelo
George – West Shore Rd
Mr.
George complained about the increase in realtor signs being placed on homes for
sell in the Borough. He suggested the Council consider adopting an ordinance
prohibiting the signs or placing a question on the ballot and letting the
voters of Mountain Lakes decide.
With no one else wishing to
be heard, Mayor Jackson closed the public comment portion of the meeting
Mayor Jackson explained that an informal
agreement had existed among the local realtors and the Borough regarding the signs. However, the Borough can not
prohibit homeowners from placing temporary signs on their property as long as
they are not on the Borough’s right-of-way and comply with our sign ordinance.
Councilman
Urankar requested that the Borough Attorney advise the Council in writing on
the above matter.

Review of Audit
The Council discussed the recommendations of the
Auditor and requested Kathi Mantell attend the June 23 meeting to discuss some
of the recommendations.

Agreement/Ferrante
Marty Murphy explained some of the particulars of
the agreement. He said the developer’s
attorney has agreed that no construction will begin until approved well permits
have been issued.

for HPC Author
The Council discussed the responsibilities of the
author and the HPC regarding final approval and sales of the centennial book.
7. ATTORNEY’S REPORT
Mr. Murphy confirmed that a $75,000 settlement was
reached by JIF in the Morris Avenue
police incident.
The Council asked Mr. Tempesta to discuss with the
Police Chief what training has occurred so that a similar situation is avoided.
8. MANAGER’S REPORT
Mr. Tempesta said that the removal of the graffiti
under the trestle was the responsibility of NJ transit. However, based on his
pass experience with the NJ Transit he has asked DPW Director Mark Prusina to
have it removed.
Mr. Tempesta reported that $18,000 of State Aid
had been restored to the Borough.
The Council discussed a proposed State water tax
referendum. The majority of Council did not support a water tax. However,
Councilwoman Emr said she was in support of the legislation.
Mayor Jackson suggested reviving the COAH
Committee to discuss information sent to the Council by Susan Kimball on COAH.
Councilman Shaw arrived at 9:10 p.m.
9. COUNCIL REPORTS
Appointments/ Planning Board
Motion by Councilman Shaw, second by Councilman
Urankar, to appoint Rainer Mimberg to the Planning Board, with all Council
members in favor signifying by “Yes” by Roll Call vote..
Motion by Councilman Shaw, second by Councilwoman
Wilson, to appoint Cory Nachshen to the Planning Board as Environmental
Commission member, with all Council members in favor signifying by “Yes”, by
Roll Call.
Motion by Councilwoman Emr, second by Councilman
Gormally, to appoint Sibel Dikengil as chair of the Municipal Alliance
Committee, with all Council members in favor signifying by “Yes” by Roll Call
vote.
10.
ADJOURNMENT
Motion by Councilman
Gormally, second by Deputy Mayor Davis, to adjourn the meeting at 10 p.m., with
all Council members in favor signifying by “Aye.”
