COUNCIL MEETING

MONDAY, JUNE 23, 2008

M I N U T E S 

 

1.      CALL TO ORDER; OPENING STATEMENT:  This meeting is being held in compliance

with Public Law 1975, Chapter 231, Sections 4 and 13, as notice of this meeting and the agenda thereof had been reported to The Citizen and the Morris County Daily Record on January 3, 2008 and posted in the municipal building.

 

Mayor George Jackson called the meeting to order at 7:30 p.m.

 

2.   ATTENDANCE AND FLAG SALUTE

All Council members were present except Councilmen Gormally and Urankar and Councilwoman Wilson.

 Also in attendance were Borough Attorney Marty Murphy, Borough Manager Joe Tempesta, and Borough Clerk Christina Whitaker.

 

3.  EXECUTIVE SESSION

         Resolution 94-08

WHEREAS, the Borough Council of the Borough of Mountain Lakes, County of

Morris, State of New Jersey finds it necessary to discuss matters relating to:

 

·        Litigation/Tax Appeals/Reassements– Zorlas and TIAA CREF

·        Police Contract Negotiations

·        Shared Services

·        Personnel/Ken Huelbig

 

WHEREAS, the Borough Council believes it to be in the best interest of the public to discuss such matters in closed session.

 

NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Mountain Lakes, that it shall enter Executive Session to discuss only those matters mentioned above; the results of which will be disclosed when the matters are resolved and upon vote of the Governing Body to release the minutes.

 

      Motion by Councilman Shaw, second by Councilwoman Emr, to enter into Executive

      Session, with all members in favor signifying by “Aye.”

 

     Councilwoman Wilson arrived at 7:35 p.m.

   

     Motion by Councilman Shaw, second by Deputy Mayor Davis, to close the Executive

     Session and return to the public portion of the meeting at 8 p.m., with all members in

     favor signifying by, “Aye”.

 

 4. SPECIAL PRESENTATION

·        Audit /Kathi Mantell and Dana Mooney

Mayor Jackson told the Council that the Finance Committee had met with Kathi

Mantell and Dana Mooney and was satisfied with the audit.

Ms. Mantell explained each item on the corrective action plan and the measures

that should be taken to correct the problems.

She noted that the purchase order system would soon allow electronic requisitions.

It was recommended that the list of vendors selling green trash bag should be shorten for better revenue control.

 

Mr. Tempesta announced the resignation of CFO Dana Mooney effective June 27, 2008. Ms. Mooney has taken a position in Stanhope. Council thanked her for her services and wished her well in her new job.

 

5. PUBLIC COMMENT

Mayor Jackson explained the Council’s policy of limiting each speaker to 5 minutes and no yielding of time to another person.

 

Mayor Jackson opened the public comment portion of the meeting with consent of Council.

 

Peter Holmberg-Hanover Road

Mr. Holmberg complained about the number of signs being erected on residential properties. He asked the Council to review the sign ordinance and amend the ordinance to address the problem.

 

Peter Bolo - Glen Road

Dr. Bolo said he noticed an increase in the number of rafts on the lakes and some were not in compliance with the Borough codes. He provided the Borough Manager with a few locations where rafts appeared to be in violation.

 

Dr. Bolo also addressed the matter of Borough Hall improvements. He told the Council that whatever had to be done must be completed as economically as possible. He suggested that the existing building be renovated to include an additional floor and a prefabricated metal building be used for additional storage space.

 

With no one else wishing to be heard, Mayor Jackson closed the Public Comment portion of the meeting.

 

Mayor Jackson told the members of the public that the sign issue would be addressed at the July 28 meeting.

 

The Council supported having a letter mailed to lake residents containing a copy of our present ordinance addressing rafts and any additional helpful information.

 

 7. ORDINANCE

     07-08

ORDINANCE AMENDING CHAPTER 237 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF MOUNTAIN LAKES AND AMENDING THE WATER CONSERVATION RESTRICTIONS.

Following introduction, the above ordinance will be published in accordance with the law

    and a public hearing will be held on July 28, 2008.

AMENDMENT TO THE SALARY, WAGE AND COMPENSATION OF THE OFFICERS AND EMPLOYEES OF THE BOROUGH OF MOUNTAIN LAKES, IN THE COUNTY OF MORRIS, NEW JERSEY.

Following introduction, the above ordinance will be published in accordance with the law

and a public hearing will be held on July 28, 2008.

 

Motion by Mayor Jackson, second by Councilwoman Emr, to table the ordinance until after the Executive Session discussion, with all members in favor signifying by “Aye”.

  10. ATTORNEY’S REPORT

  The Morris Avenue police incident will be discussed at the July meeting when Police Chief

  Tovo can be present.

    

11. MANAGER’S REPORT

The HPC contract has been resubmitted with some changes. Once reviewed by Mr. Murphy,

Mr. Tempesta and the author will sign the contract.

 

 

  Borough Hall

The next meeting of the Facility Committee is scheduled for July 2 at 3 p.m.

 

Well #3

Borough Engineer Bill Ryden, DPW Director Mark Prusina and Mr. Tempesta recommended that the electricity going to the well be installed underground. The cost difference would be $4000 for underground installation.

Councilwoman Emr did not think underground lines were necessary and expressed some concerns because the well is in a flood area.  The other Council members supported the professionals’ recommendations.

 

Memorial Bench at Island Beach

Mr. Tempesta said the bench to be donated met the Council’s memorial policy.

A concern was raised over the anchoring of the bench. Mr. Tempesta will check with Mr. Prusina regarding the matter.

 

  COAH/Affordable Housing

  The COAH Committee will be meeting with Susan Kimball tomorrow to discuss round three,

   Mr. Tempesta told the Council that the NJ League of Municipalities is planning to file a lawsuit

   against COAH claiming that the vacant land analysis was flawed.

 

   Councilwoman Wilson noted that the fire whistle became stuck on two occasions over

   the weekend.

   Mr. Tempesta said he was aware of the problem, which occurred at the 6:45 p.m. testing, and

   that it was being repaired.

 

   Councilwoman Emr asked that Code Enforcement Officer Dan Hagberg continue to monitor 

   Boulevard signs.

 

  Mr. Tempesta told the Council that some State aid might be coming back to the municipality.

  Any money received will be used to offset the tax rate.

 

  The Manager said he planned to have the “State of Borough” report to the Council in

  September.

 

  Councilman Shaw noted that the dock next to the volleyball court at Birchwood Lake needed

  repairs. Mr. Tempesta said he was aware of the problem.

 

  12. COUNCIL REPORTS

  Councilman Shaw said the beaches opened on Sunday without any problems.

  There are 200 children in the swim classes.

  Councilman Shaw informed everyone that $4000 had already been collected for the

  July 4th fireworks.  The goal was $10,000.

  Councilman Shaw said there were several interested candidates for the upcoming

  vacancy on the Planning Board.

 

  Motion by Councilwoman Wilson, second by Councilman Shaw to appoint Sam Tomarchio to

  the Web Site Committee, with all members in favor signifying by “Aye”

 

Motion by Councilwoman Emr, second by Deputy Mayor Davis, to go back into Executive

Session to discuss the remaining items, with all members in favor signifying by “Aye.” 

 

Motion by Deputy Mayor Davis, second by Councilwoman Wilson, to close the Executive Session and return to the public portion of the meeting, with all members in favor signifying by “Aye.”

           Motion by Councilman Shaw, second by Deputy Mayor Davis, to adjourn the meeting at 9:45 p.m. with all members in favor signifying by “Aye.”
