COUNCIL MEETING

M I N U T E S  

 

1.   CALL TO ORDER; OPENING STATEMENT:  This meeting is being held in compliance

with Public Law 1975, Chapter 231, Sections 4 and 13, as notice of this meeting and the  

agenda thereof had been reported to The Citizen and the Morris County Daily Record on

January 3, 2008 and noticed to The Star Ledger, Daily Record and The Citizen on August

18, 2008 with the time change and posted in the municipal building.

 

Mayor Jackson called the meeting to order at 7 p.m.

 

2.   ATTENDANCE AND FLAG SALUTE

All Council members were present.

 

 Also in attendance were Borough Attorney Marty Murphy, Borough Manger Joe Tempesta, Tax Assessor Rick DelGuercio and Borough Clerk Christina Whitaker.

 

3. EXECUTIVE SESSION

         Resolution 114

WHEREAS, the Borough Council of the Borough of Mountain Lakes, County of

Morris, State of New Jersey finds it necessary to discuss matters relating to:

 

·        Shared Services Negotiations

·        Potential Tax Appeal Litigation/Uniform Borough Tax Reassessment

 

WHEREAS, the Borough Council believes it to be in the best interest of the public to discuss such matters in closed session.

 

NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Mountain Lakes, that it shall enter Executive Session to discuss only those matters mentioned above; the results of which will be disclosed when the matters are resolved and upon vote of the Governing Body to release the minutes.

 

Motion by Councilman Shaw, second by Councilwoman Wilson, to enter into Executive Session at 7:03 p.m. with all members in favor signifying by “Aye.” 

 

Motion by Councilman Shaw, second by Councilwoman Wilson, to close the Executive Session at 8:00 p.m. and return to the public portion of the meeting, with all members in favor signifying by “Aye.” 

 

 Motion by Councilman Urankar, second by Deputy Mayor Gormally, to have the Tax Assessor do an in–office assessment adjustment on house values, with all members in favor signifying by “Aye.”

 

4. COMMUNITY ANNOUNCEMENTS

Councilman Shaw Congratulated the Mountain Lakes Summer Swim Team for winning the Hub Lakes Championship.

 

5. PUBLIC COMMENT

Mayor Jackson explained the Council’s policy of limiting each speaker to 5 minutes and no

yielding of time to another person.

 

Mayor Jackson opened the public comment portion of the meeting with consent of

Council.

 

 With no one wishing to be heard, Mayor Jackson closed the public comment portion of the meeting.

 

6. ORDINANCE

 

   09-08

   ORDINANCE DETERMINING POSITIONS ELIGIBLE FOR THE DEFINED

   CONTRIBUTION RETIREMENT PROGRAM. 

If adopted this ordinance shall take effect after publication and passage as provided by

   law.    PUBLIC HEARING

 

Mayor Jackson opened the public hearing with consent of Council.

7. DISCUSSION

   A. Signs/Gormally  (Hereto attached)

   The Council discussed the clarity of the present sign ordinance and the ability to enforce

   the ordinance.  The ordinance lends to confusion on the permitted location of signs on 

   private property as well as Borough property.  The consensus of the Council is that there

   has been an unacceptable increase of “temporary” and “contractor” signs in the  

   community. The Council discussed making it mandatory to obtain a permit to put up

   temporary signs.  The consensus of the majority of the Council was to also prohibit “contractor” signs.  Deputy Mayor Gormally and Councilwoman Emr will highlight areas of 

   concern in the present ordinance and provide the information to the Borough Attorney for

   drafting of an amendment to the ordinance.

Update of Municipal Projects

Further work on the Birchwood Lake wall will begin about the latter part of September.

Mayor Jackson reminded the Manager that Mark Prusina and Bill Ryden should make a presentation on street signs within the next month.

 

Mr. Tempesta explained the transaction of Dana Mooney from full-time to part time

  employment. Ken Huelbig has been handling the position nicely and at some point will be able to take over as full-time CFO.

Ann Purcell has been hired as Payroll Administrator and Appropriations Clerk and is working

out very well.

Celia Flynn started as Recreation Director just before summer programs were in full swing.

 

  13. COUNCIL REPORTS

  Councilwoman Emr informed the Council that Cathy Harvey has agreed to be acting 

  Chair for the Environmental Commission.

  The Environmental Commission feels that the Deer Management Program should be under the

  direction of the Woodlands Committee. The Council concurred.

  An Environmental Summit is being planned with experts to speak on environmental issues.

 

 The Fire Department plans to have a recommendation on the need for a rescue boat by 

 October. 

 

 Mayor Jackson announced that Jerry Uhrig has unfortunately resigned as Chair and from the Woodlands Committee effective immediately.

 

Appointments

 

  Motion by Councilwoman Emr, second by Deputy Mayor Gormally, to appoint Howard

  Sawransky to the Municipal Alliance Committee with all members in favor signifying by “Aye.”

  Vote: 7-0

 

Motion by Councilman Shaw, second by Deputy Mayor Gormally, to appoint Peter Holmberg as 2nd Alternate to the Planning Board, with all members in favor signifying by “Aye,” with Councilwoman Emr voting no. Vote: 6-1-0

 

 

Motion by Councilman Shaw, second by Deputy Mayor Gormally, to appoint Jay Conlan to the

  Traffic and Safety Committee with all members in favor signifying by “Aye.” Vote: 7-0  

 

Borough Hall Facility

The Facility Committee would like to have a special meeting later in September or early

October so the public would have the opportunity to hear the recommendation of the

architect and Committee. There is a conceptional plan for a new building adjacent to Borough Hall. The price is estimated at about $5 million.

 

Councilman McWilliams will serve as liaison to the Zoning Board and Recreation

Commission.

 

 14. ADJOURNMENT

 Motion by Councilman Urankar, second by Councilman McWilliams, to adjourn the meeting at 10:15 p.m. with all members in favor signifying by “Aye.”
