COUNCIL MEETING

MONDAY, SEPTEMBER 8, 2008

M I N U T E S 

 

1.   CALL TO ORDER; OPENING STATEMENT:  This meeting is being held in compliance

with Public Law 1975, Chapter 231, Sections 4 and 13, as notice of this meeting and the  

agenda thereof had been reported to The Citizen and the Morris County Daily Record on

January 3, 2008 and posted in the municipal building.

 

Mayor Jackson called the meeting to order at 7:37 p.m.

 

2.   ATTENDANCE AND FLAG SALUTE

All Council members were present except for Councilman Urankar and Councilwoman

Wilson.

 

 Also in attendance was Attorney James Brice, sitting in for Marty Murphy, Borough Manger 

 Joe Tempesta, and Borough Clerk Christina Whitaker.

 

3.  EXECUTIVE SESSION

         Resolution 121

WHEREAS, the Borough Council of the Borough of Mountain Lakes, County of

Morris, State of New Jersey finds it necessary to discuss matters relating to:

 

·        Attorney – Client Privilege / Settlement – Trash Bag Agreement

 

WHEREAS, the Borough Council believes it to be in the best interest of the public to discuss such matters in closed session.

 

NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Mountain Lakes, that it shall enter Executive Session to discuss only those matters mentioned above; the results of which will be disclosed when the matters are resolved and upon vote of the Governing Body to release the minutes.

 

Motion by Councilman Shaw, second by Deputy Mayor Gormally, to enter into Executive Session, with all members in favor signifying by “Aye.”

 

Motion by Councilman Shaw, second by Deputy Mayor Gormally, to close the Executive Session and return to the public portion of the meeting at 8:08 p.m., with all members in favor signifying by “Aye”.

 5. PUBLIC COMMENT

 Mayor Jackson explained the Council’s policy of limiting each speaker to 5 minutes and no

 yielding of time to another person.

 

 Mayor Jackson opened the public comment portion of the meeting with consent of

 Council.

 

  With no one wishing to be heard, Mayor Jackson closed the public comment portion of the meeting.

    9. ATTORNEY’S REPORT- None

           

10. MANAGER’S REPORT (Hereto attached)

The Facility Committee will hold its next meeting on Thursday. The Committee will

discuss a date to hold a public presentation meeting.

 

  The water levels in all the lakes are low. However, residents around Mountain Lakes and Wildwood Lake are happy with the quality of the lakes.

The dams are being checked routinely for vandalism. 

 

Several swim team parents have complained about the landscaping and maintenance at Birchwood Lake.

 

   11. COUNCIL REPORTS

Appointments

Councilman Shaw said there are vacancies on the HPC. He said before doing any more work

at the Esplanade, the Garden Club and HPC would like to be consulted. Both Committees hope the work will be completed in time for the Centennial.

 

Patricia Herold continues to work on the Centennial Book.

 

 

The HPC wishes the Council to submit a name to the Historic Preservation Review Board to

fill a vacancy on the Board that will occur January 1, 2009. The Board is looking for a

municipal representative from Region III, which includes Mountain Lakes. The Board’s role is to make recommendations to the Freeholders regarding funding of historic preservation projects in the County.

 

Zoning Board Chairman Peter Bolo said the Board of Adjustment is looking for clarification of

language and definitions in some ordinances.  The Mayor received a letter from the Zoning

Board asking the Council to address these issues.

 

  Deputy Mayor Gormally and Councilwoman Emr will have a discussion item prepared on the sign ordinance for the October 14, 2008 meeting

 

  No date has been set for the environmental summit.

 

Motion by Councilman McWilliams, second by Councilman Shaw, to return to Executive Session at 9:05 p.m. to discuss the matter referred to in Resolution 121, with all members in favor signifying by “Aye.”

 

Motion by Councilman McWilliams, second by Deputy Mayor Gormally, to return to the public portion of the meeting at 9:30 p.m., with all members in favor signifying by “Aye.”

 

12. ADJOURNMENT    

Motion by Councilman McWilliams, second by Councilman Shaw, to adjourn the meeting at 9:40 p.m., with all members in favor signifying by “Aye.”
