M I N U T E S

 

1.     CALL TO ORDER; OPENING STATEMENT: This meeting is being held in compliance

 with Public Law 1975, Chapter 231, Sections 4 and 13, as notice of this meeting and the agenda thereof had been reported to The Citizen and the Morris County Daily Record and The Star Ledger on January 5, 2010 and posted in the municipal building.

 

       Mayor Blair Bravo called the meeting to order at 7:35 p.m.

           

2.  ATTENDANCE AND FLAG SALUTE

       All Council members were present except for Deputy Mayor Gormally and Councilwoman Emr.

       Also in attendance were Borough Attorney Marty Murphy, Borough Manager Barry Lewis, and Borough

       Clerk Christina Whitaker.

                                                                                               

3. EXECUTIVE SESSION

                 Resolution 113-10

                 WHEREAS, the Borough Council of the Borough of Mountain Lakes,

 County of Morris, State of New Jersey finds it necessary to discuss matters relating to:

 

·        Litigation/Williams Stationery

·        King of Kings/Contract Negotiations

 

                        WHEREAS, the Borough Council believes it to be in the best interest of the

         public to discuss such matters in closed session.

           

                         NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough         

        of Mountain Lakes, that it shall enter Executive Session to discuss only those matters 

        mentioned above; the results of which will be disclosed when the matters are resolved and

        upon vote of the Governing Body to release the minutes.

 

       Motion by Councilman Shaw, second by Councilman Happer, to enter into Executive Session, with all

       members in favor signifying by “Aye.”

 

       Councilwoman Emr arrived at 7:50 p.m.

 

       Motion by Councilman McWilliams, second by Councilman Jackson, to close the Executive Session and

       return to the public portion of the meeting, with all members in favor signifying by “Aye.”

 

4. COMMUNITY ANNOUNCEMENTS

The dedication of the turf football field will be held the weekend of October 8 and 9. The field will be named in honor of Doug Wilkins.  Mr. Wilkins served the community as principal of the high school and 44 years as coach of the HERD.

 

Councilwoman Emr thanked Mr. Lewis, Mrs. Whitaker and Borough Clerk Assistant Debra Peniston for assisting a young couple who forgot to pick up their marriage license before the Borough office closed on Friday. The couple was to be married in Mountain Lakes the next day.  It ended Happily Ever After.

 

 

5. PUBLIC COMMENT

Mayor Bravo opened the public comment portion of the meeting with consent of the Council.

 

Mayor Bravo explained the Council’s policy of limiting each speaker to five (5) minutes and no yielding of time to another person.

 

With no one wishing to be heard, Mayor Bravo closed the public comment portion of the meeting.

        8. ATTORNEY’S REPORT

        Mr. Murphy had nothing to report.

 

        9. MANAGER’S REPORT

        Mr. Lewis has received a draft energy audit report on the Borough Hall but has not yet received the

        energy audit.

        Councilman Happer said that the Facility Committee was anxious to receive the report so it could more

        forward with recommendations.

       

       The Manager said he had contacted the NJDEP with five available dates for Bill Ryden and him to meet to  

        discuss well #3 and the allocation total for this year.  He has not received a response from Trenton yet.

 

       Mr. Lewis reminded the Council that he would be meeting with the Morris County Open Space Committee

       on October 2 at 3:45 p.m. to walk the property at King of Kings. Mayor Bravo will accompany Mr. Lewis.  

       Councilman Shaw and McWilliams said they would like to attend.

 

       Status of 2010 Capital Projects (memo attached)

 Councilwoman Emr and Councilman Jackson said they would like a more comprehensive report on the capital projects, including money allocated for the projects, money spent to date on the projects, and any projects that have not begun but were included in the 2010 proposed projects.

 

 

Councilman Jackson asked if it was necessary to keep a separate meeting room as the Council chambers.

 

He noted the Board of Education meets in the high school library and other committees meet in the Mountain Lakes library building. He said if the room was vacated it would free up an area in the building for other services. 

       

The Council said it would like a summary from Tax Assessor Rick DelGuercio on whether there was a need for another property revaluation, based on recent home sales.

 

Councilman Shaw asked if the Lakes Management Advisory Committee had made a decision on lowering Mountain and Wildwood Lakes this year.

Mr. Lewis said the Committee had recommended lowing so he applied to the State for a permit a couple of  weeks ago but had not received any answer yet. If the lakes were lowered it would have to begin immediately because the State requires lowering of lakes to stop by November 1, and only a maximum of two feet. He noted all residents with lake property would be notified of the lowering of the lakes.

  

10. COUNCIL REPORTS

 HPC

Motion by Councilman McWilliams, second by Councilman Shaw, to appoint Tom Dagger and John Grossman as co-chairs to the HPC, with all members in favor signifying by “Aye.”

                      

Councilwoman Emr said the Traffic and Safety Committee talked about sidewalks and eliminating the crossing guard at Elm and Morris Ave.

The Traffic and Safety Committee and the Green Team (Sustainable NJ) will be working together to look for grants that would help pay for the development of a loop sidewalk route around to the schools.

 

Councilwoman Emr said that several department heads and Committee/Commission chairs have met to review the outdated Mountain Lakes Residents Guide and suggest changes and updates. No recommendation has been made yet on how the material should be distributed.

 

Councilman Shaw and Happer said that they would recommend having it placed on the Borough web site.   

 

Councilman Jackson said the Planning Board was reviewing the Master Plan, two chapters at a time, and then having a public hearing on those chapters.

 

There will be a presentation by Cory Nachshen at the next Planning Board meeting on the interaction of the ERI mapping.

 

The Personnel Committee is reviewing health and educational benefits, holidays, sick and personal days offered employees.

 

Councilman Shaw said the Recreation Commission would like to attend the October 25 meeting to give its end-of-year report.

 

     11. ADJOURNMENT

     Motion by Councilman Shaw, second by Councilman Happer, to adjourn the meeting at 9:12 p.m.,
